CJI Calls Hathras Incident Horrible, Shocking, Extraordinary

New Delhi: The Supreme Court CJI on Tuesday named the Hathras incident horrible, shocking and extraordinary as it looked for an affidavit from the Uttar Pradesh government on three aspects: how the family and witnesses are being ensured; has the family picked an attorney to help them in the issue and what is the extent of the Allahabad High Court procedures and how might it enlarge its degree.

A bench led by Chief Justice S.A. Bobde said the court will guarantee the investigations concerning the issue is smooth.

“The Hathras incident is horrible, shocking. We are hearing you as the incident is extraordinary,”: stated CJI to senior advocate Indira Jaising, representing an intervenor in the matter.

Jaising presented before the bench that she would not like to meddle with the investigation and demanded on the transfer of the case starting with one state to another. She additionally referred to that 27 FIRs have been filed against many protesters in the issue and stressed on giving witness protection.

Tushar Mehta, the Solicitor General, representing the Uttar Pradesh government, presented that outside the courts, a few accounts were being weaved, and this could reach a conclusion by monitoring and inspection by a central agency.

Mehta emphasized that the family has just been given police protection.

Jaising said justice should be possible just by moving the trial to Delhi and included that a judicial inquiry, under the administration of a past judge is best.

Mehta stated: “Things are being argued in the court without knowing the facts. Witnesses are being protected.”

After a point by point hearing in the issue, the top court gave notices and adjourned it to the upcoming week for the state to register another affidavit on the three aspects.

The comments from the top court were made during the hearing of a PIL registered by a social activist looking for CBI or SIT test in the Hathras episode in which a 19-year-old Dalit young girl was allegedly sexually assaulted by men belonging to the upper caste and afterward reportedly dragged her by the neck with her dupatta on a field in Bulgari village. The casualty was partly paralyzed and passed away after fighting for 14 days. She was moved from Aligarh hospital to Delhi’s Safdarjung Hospital on September 28.

She passed away on September 29 and was cremated at 3 a.m. on September 30. The family has asserted coercion regarding to the time and way in which the cremation occurred.

Petitioner’s lawyer said: “We are shocked at the incident.”

The Chief Justice responded everybody is stunned, and questioned the attorney on his client’s locus in the issue.

“When a court asks you why are you here, you have to give different reasons, we understand your anxiety,”: as noted by the bench.
