Family of Hathras Victim go to Court Against ‘Illegal Confinement’

Prayagraj: A petition has been registered in Allahabad High Court on account of the family members of the Hathras casualty, alleging that the district administration has wrongfully confined them in their home.

The court has been mentioned to coordinate the district administration: ” Hathras Victim family members be released from illegal confinement and allowed to move out of their house and meet people”.

This habeas corpus writ request, registered by the family of the casualty is registered on October 8 for hearing.

The father of the victim, Om Prakash, alongside her mother, two more relatives, and two brothers have registered the petition.

In the petition, it has been affirmed that on September 29 the petitioners were wrongfully confined in their home by the district administration, and from that point forward they are not being permitted to meet anybody.

It has been additionally asserted that: “though, at a later stage, a few people were allowed to meet the petitioners, the district administration is still not allowing them (the petitioners) to move out of their house at free will”.

In this appeal, the petitioners have affirmed that they were being kept from meeting or communicating openly, accordingly their entitlement to the right to speak freely and expression, just as the right to get information, is being infringed.

In the appeal, one Surender Kumar, declaring himself to be the national general secretary of the Akhil Bhartiya Valmiki Mahapanchayat, has expressed that he was approached by the petitioners over the phone and in the interest of them he has registered the petition.

The habeas corpus writ appeal is registered under the watchful eye of the high court when an individual is wrongfully confined.

During the court procedures, in the event that the court finds that the individual is wrongfully confined, at that point it can arrange for the release of that individual.
