Supreme Court Calls Goa State Election Commission Appointment As “Constitution Mockery”

The Supreme Court gave their judgment regarding the appointment of Election Commissioners. This comes after a government official was given the post of an Election Commission in Goa.

 

Supreme Court Calls Goa Election Mockery Of The Constitution

The bench was headed by Justice R.F Nariman to take the decision regarding the Goa Election Commissioner. He said that giving someone an additional responsibility to be the State Election Commission when they are already working for the government is a “Mockery of the Constitution”.

He further said that the Election Commission is an independent body and its independence shall not be compromised. An Election Commissioner is an independent office and shall not be the one who already works for the government.

“The independence of the Election Commission cannot be compromised in a democracy”, said the Supreme Court.

Goa Government Appointed Law Secretary As State Election Commission

The incident came after the Goa government moved to the Supreme Court to challenge the Bombay High Court order. The Bombay HC had cancelled elections for five municipalities in the state as they had not reserved the wards for women (required by the law).

The Goa government had initially appointed their law secretary as the State Election Commission for conducting the Municipal Council Elections.
