Telecommunication Companies Face Setback As SC Rejects AGR Rectification Plea

The Supreme Court in the latest update has dismissed the plea seeking ‘rectification’ of the defects in computation of adjusted gross revenue. They said that the plea would lead to recalculation of the amounts in AGR dues.

Telcos Faces Set Back 

As per the latest reports, the Supreme Court dismissed their plea to correct the alleged errors in   The telecos had urged the supreme court to permit the Central government to verify their accounts and rectify the alleged defects regarding the AGR dues. They stated that if the requested isn’t done, it could threaten their position within the highly competitive sector.

The bench headed by Justice L. Nageswara Rao said that that the correction of the defects or the arithmetical errors in the calculation of AGR dues would only lead to recalculations and reassessment which was already rejected by the top court in the order dated July 20, 2020.

The order stated that the dispute regarding the AGR dues has been in court since a long time and the AGR dues payable by the Telecom Services Providers cannot be subject to any further litigation.

Advocates Argue That The Amount Already Paid Has Not Been Taken Into Account For AGR Dues

Reports suggest that the Senior Advocate Mukul Rohatgi who represents Vodafone Idea said that there were certain errors in the demand raised by the Centre where the amounts that have already been cleared by the company were not calculated by the AGR outstanding dues.

Similarly, Senior Advocate Abhishek Singhvi who represents Airtel also submitted that the errors committed in the calculations of AGR dues show double the amount and some payments have not been included.

Singhvi said that his client should not be made to suffer for certain calculation errors made by the Centre. Meanwhile, Senior Advocate Arvind Datar who represents Tata said that there is no prohibition against the companies to not seek rectification in the calculation of AGR dues.
