The Allahabad High Court in a recent hearing has granted bail to the accused after they were alleged with case of sex on the false promise of marriage. They said that the complainant who is 35 years old widow should have been aware of the repercussions of pre-marital sex with an unknown person.

Complainant Refused To Get Medical Examination 

During the hearing, Justice Rahul Chaturvedi said that there is no doubt that the victim should have known the “repercussions of pre-marital sex with an unknown”. He further pressed that the victim also denied to get the medical examination done to establish rape charges against the accused.

Justice Chaturvedi relied on the Supreme Court judgements in Dr Dhruvaram Murlidhar Sonar case and Pramod Suryabhan Pawar case and said that the taking guidance from both the cases, the submissions made by the counsel against the accused appear to convincing for the purpose of bail.

Accused Ousted The Victim After 2 Years 

The victim registered the FIR on December 4, 2020 where the victim said that her husband had expired back in 2016 and eventually developed intimacy with the accused. She said that she had fallen in love with the accused and then established physical relationships. The accused had promised to marry her and the relationship lasted for two years without any resistance or objected from the complainant. However, after some time, the accused refused to marry her and abused and humiliated her and also issued life threats.

The woman’s counsel has argued that the accused had exploited a saddened widow after winning her confidence with a false promise of marrying her and then ravished her for two years only to last oust her from his life.
