Central Govt Moves Supreme Court Against Karnataka High Court Order For Medical Oxygen Supply

The Supreme Court recently overruled the Central government’s plea against Karnataka High Court. The high court ordered a supply of 1200 MT oxygen.

Supreme Court Sides With Karnataka High Court 

As per the latest reports, Justice D.Y Chandrachud released a statement towards Solicitor General Tushar Mehta. He said that the move made by the Karnataka High Court is a “well-calibrated, well-considered” judicial order. He said that they will not leave the citizens of Karnataka in challenging times like these.

This comes after Mehta filed an objection from the Centre’s behalf against the Karnataka High Court for (reportedly) interfering with the Central government’s allocation of medical oxygen supply, especially amidst the pandemic and shortage of oxygen.

However, the Supreme Court said that they understand the difficulty that the Central government is facing. But they also have to think about the patients whose oxygen requirements are not met by the state. Furthermore, it would be “grave injustice” to the people. The central government claimed that if the court starts to interfere with the allocation of medical oxygen, it would become unworkable.

Mehta urged the top court that situations like these will be a great difficulty as the High Courts will start to examine and allocate the oxygen supply to their respective states. He asked the Supreme Court to order that this shall not be treated as a precedent.

Responding to the same, Justice Chandramud said that the court is looking at a much wider issue.

Central Government Moves Supreme Court Against High Court Interference in Medical Oxygen Supply 

The Central government on Thursday moved towards the Supreme Court against the Karnataka High Court. The Karnataka High Court ordered the Central government to supply the state with a 1200 MT oxygen supply against the 965 MT allotted by the government for the treatment of the Covid 19 patients.

For the past several days, the Supreme court has been hearing disputes between the Centre and other states regarding the supply of medical oxygen amidst the rising Covid 19 cases.
