SC Cancels Land Allotments in GHMC Limits, Impacting MPs, MLAs, Officials, and Journalists

The Supreme Court has canceled certain land allotments made to housing societies within Greater Hyderabad Municipal Corporation (GHMC) limits, affecting MPs, MLAs, civil servants, judges, defense personnel, and journalists.

The verdict, delivered by Chief Justice Sanjiv Khanna, also ordered refunds of all amounts paid by the societies, including stamp duties and registration fees, with interest at RBI rates.

The Court quashed several government orders (G.O.Ms.) that had allocated land to specific groups at subsidized rates, ruling that they violated Article 14 of the Indian Constitution, which guarantees equality before the law.

The canceled orders included those from 2005 and 2008, which had extended special land allotments to public representatives and officials.

The ruling directly impacts members of societies like the Jawaharlal Nehru Journalist Housing Society, which had received land from the Telangana government. The State of Telangana has been directed to handle the land in accordance with the Court’s findings and to refund all amounts paid by the societies, including development charges, with interest.

This decision raises questions about the legality of such land distributions and could serve as a precedent for future challenges to similar allotments. The allottees now face uncertainty over the status of their plots, with their lease deeds canceled. The case underscores the need for more transparent and equitable land allocation practices across India.
