A court decision on Wednesday stated that only the state government can decide whether to prohibit the sale and distribution of alcohol and that courts cannot do so. Nevertheless, the court wasn’t inclined to interfere with state policy decisions about alcoholic liquid production, distribution, and sale.
The division bench led by Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili heard a public petition filed by an elderly couple from Jadcherla asking the court to prevent alcoholic beverages from being produced, sold, and consumed in Telangana.
An alcohol-abusing son Sridhar Goud, who lost his job as a police constable because of his addiction, which made his wife leave him was the subject of a writ case filed in 2016. The couple also asked for the government to take responsibility for the treatment of their son after he became addicted to alcohol due to the government’s decision to allow the sale of alcohol without any limits.

Because their son’s threatening behavior made them fear for their lives, they claimed their constitutional rights under Article 21 were being violated.
It has been over a year since the petition was filed, however. Gujarat and Bihar imposed alcohol prohibition by state policy decisions, and now the petitioners are asking the court to intervene in those decisions in 2022.
Following consideration of the petitioners’ request, the High Court registry converted it into a PIL. When the case was changed into a civil action, it was heard by a division bench headed by the Chief Justice, and the plea was denied.
When making such a policy decision, the state government must take into account a number of different factors and action must be taken solely by them.
As the bench stated, “It is for the politicians to take the final decision on the sale and purchase of liquor in Telangana.” This Court cannot do this because the petitioners’ kid has become addicted to alcohol.
