Another SC judge walks out of a Bengal-related case

After the recent exit of a Supreme Court Judge from a case related to West Bengal, another judge refrained from taking up the matter involving Mamata Banerjee-ruled state. This is the second time in 2 weeks when such a situation occurred. 

The incident took place after Justice Aniruddha Bose, hailing from Kolkata, dropped out from a case that included Bengal Chief Minister’s petition in the Narada bribery case. Withdrawing herself from the matter, she said, “I do not want to hear this case”.  

Justice Vineet Saran will now head the bench, which will hear the plea on Friday filed by Mamata Banerjee. “This is a new case which has come to us now. We have not yet read the file. So let us have it on Friday,” Justice Saran said. 

Before Ms Bose, Justice Indira Banerjee had walked out of a different case last week that was related to the violence that erupted across Bengal following Trinamool’s massive victory of May 2nd. The CBI was requested through a petition for a detailed investigation into the murder of 2 BJP workers, an incident that took place during the clash between BJP and Trinamool workers following Mamata Banerjee’s victory.

However, the case Ms Bose opted out of today was related to the Bengal Chief Minister and State Law Minister Moloy Ghatak’s petition in the SC challenging Calcutta High Court’s decision to not accept their affidavits in the Narada bribery case.  

This was after the CM and Law Minister approached the HC to record affidavits mentioning their perception of the CBI’s request to transfer the Narada case out of Kolkata citing “mobocracy” in Bengal.  

The High Court refused to file these as it said the party took a calculated risk of not filing the affidavits during the right time, hence, “now they cannot be allowed to file the affidavits at their own whims and fancies.” 

The CBI moved the court to shift the Narada case as it was receiving pressure from the state government, it said. May 17th‘s protest by Mamata Banerjee and her party members at the CBI office after 4 Trinamool leaders were arrested added fuel to the Central Bureau of Investigation’s concern. It alleged that the CM reached the court with a mob when the arrested workers were being produced in court for their hearing.
