Hyderabad: MLA’s son files discharge petition in Jubilee Hills gangrape case

In the shocking Jubilee Hills gangrape case, the son of an MLA, accused of outraging the modesty of a 17-year-old girl, filed a discharge petition in a special court for POSCO cases on Monday. In the case, the accused on bail claimed innocence.

Among the six accused, five are charged with gangrape and other offenses, while the MLA’s son has been charged with outraging the modesty of the girl.

Four of the five accused of gangrape are minors. The Juvenile Justice Board (JJB) had previously ruled that they should be tried as adults. As the MLA’s son is also a minor, the JJB ruled that he should be tried as a juvenile under the JJ Act.

In its preliminary assessment order issued on Friday in the Jubilee Hills minor girl rape case, the Juvenile Justice Board (JJB) stated that four of the five juveniles can be tried as adults in regular POCSO court because the crime committed by them is heinous. Since the fifth juvenile was not involved in the rape of the minor girl, he cannot be tried.

Given the severity of the situation, the Hyderabad police department petitioned the JJB for permission to charge all five juveniles as majors.

Jubilee Hills gangrape case

The gang-rape of the girl took place in Jubilee Hills on May 28 in a car.

Following a daytime party at a bar, they trapped the victim and sexually assaulted her after offering a lift.

One major and four minors are being charged under relevant sections of the Indian Penal Code (IPC), the Protection of Children from Sexual Offences Act (POCSO), and the Information Technology Act.

While the sixth minor was not involved in the rape, he kissed the victim in the car. Accordingly, he has been booked under the relevant sections.
