Raja Singh’s PD Act case adjourned to October 20 by Telangana HC

The hearing in the writ petition filed by suspended BJP MLA T Raja Singh’s wife Usha Bai challenging his detention under the Preventive Detention (PD) Act was adjourned on Tuesday by the Telangana High Court.

A division bench of Justices A Abhishek Reddy and Juvvadi Sridevi heard the case and ordered the state to file a counter by October 20.

Meanwhile, the Telangana government’s special government pleader, Mujib Kumar Sada Shivuni, asked the court for more time to file a detailed counter.

Senior counsel L Ravi Chander appeared for BJP MLA Raja Singh, arguing that because the police failed to furnish documents to the legislator in a timely manner, he should be released from jail, dismissing the PD Act proceedings issued by the Hyderabad police.

After the legislator’s remarks against Prophet Muhammad in a “stand-up comedy” video, Hyderabad police invoked the stringent PD Act and lodged him in Cherlapally jail.

Earlier, on September 7, the court issued a notice to the Mangalhat police station’s station house officer, directing them to file a counter within four weeks.

Usha Bai, who called the detention illegal, also asked the court to issue orders quashing the Hyderabad police’s proceedings of the PD Act against the suspended legislator.

The petition filed by activist Abdhau Kashaf has also been adjourned to November 11 by the same division bench.

Background of Raja Singh’s remarks

After the video of him making derogatory remarks about Prophet Muhammad was released on August 22, police decided it was enough. They booked cases in various police stations in order to keep Hyderabad as a “communal riot-free state.” Raja Singh was arrested the next morning.

In the YouTube video, the suspended BJP MLA made several derogatory remarks about Muslims and the Prophet Muhammad. He was essentially unable to let go of the fact that standup comedian Munawar Faruqui was permitted to perform in the city.
