TS HC directs MLA poaching case accused to ‘surrender in 24 hrs’

In the case involving the alleged poaching of Telangana Rashtra Samithi (TRS) MLAs, the Telangana High Court on Saturday directed the three BJP-linked accused to surrender before the police within 24 hours.

The court ruled in favor of the state, allowing the revision plea, and directed Ramachandra Bharati alias Satish Sharma, Nanda Kumar, and Simhayaji Swamy to surrender to the police after their release on Friday.

In its ruling, the court set aside the Anti-Corruption Bureau Court’s ruling wherein it had rejected the remand of the accused.

After the state appealed the ACB Court’s denial of the accused’s detention, the HC granted the state government a lunch motion challenging the denial of the three accused’s remand in the case pertaining to the attempt to purchase four TRS MLAs.

The court released the three accused but ordered them not to leave the city or tamper with evidence. Their whereabouts were to be reported to the Commissioner of Police Hyderabad.

The three accused were apprehended by police from a farmhouse in Moinabad, near Hyderabad, on the night of October 26 while allegedly attempting to entice four TRS MLAs with large sums of money.

The raid was carried out by Cyberabad police following a tip-off from Pilot Rohit Reddy, one of the MLAs. He claimed that the accused offered him Rs 100 crore and Rs 50 crore to three others.

The accused were charged under several sections of the Indian Penal Code (IPC) and the Prevention of Corruption Act. On the night of October 27, they were brought before a magistrate, who refused to commit them to judicial custody due to a lack of evidence.

Police released the accused in accordance with court orders. Later, the police petitioned the Telangana High Court, challenging the lower court’s orders.

The TRS team leaked audio tapes of Ramachandra Bharati and Rohit Reddy’s phone conversation on Friday. The accused discussed the ‘deal’ to buy MLAs and named several top BJP leaders.
