Telangana High Court advises avoiding delays in matrimonial disputes

A two-judge Bench of the Telangana High Court advised Family Courts in the state to avoid any kind of delay in matrimonial disputes.

The Bench, which included Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili, was hearing a writ petition filed by Syed Ahmed Moinuddin Jaffer and others against the action of Addl Family Court Judge, Hyderabad in not disposing criminal petitions that were pending before him. Cases involving matrimonial disputes, according to the petitioner, have been pending for a long period.

The Bench ordered the presiding officer to make a decision as soon as possible and not to grant more than a 15-day delay. The Bench stated that if the issues are adjourned for longer than the specified period, the reasons should be documented.

Manual scavenging

The Bench merged two public-interest writ pleas on manual scavenging. S Jeevan Kumar filed a petition in which he asked the court to order the Hyderabad Metropolitan Water Supply and Sewerage Board and the GHMC Commissioner to conduct medical check-ups for all sewerage workers and to prohibit the practice of hiring individuals to clean drains and manholes.

The petitioner said that a similar case involving the death of two sanitation workers who died while cleaning a septic tank in Kondapur in November 2021 was pending before the court. While adjourning the case, the Bench expressed concern for those who give their life for the betterment of others.

Asset safeguarding

The same Bench further ordered the Special Government Pleader of the Endowments Department to file a counter in connection with the upkeep and protection of temples/churches and other properties in the Nizamabad district. A letter addressed to the Bench by the Principal District Judge of Nizamabad was being treated as a suo moto PIL by the Bench.

The Bench also heard a report from the Secretary of the District Legal Services Authority on asset maintenance and protection. The letter and report also addressed encroachments on a mandapam, as well as a lack of facilities. The matter was adjourned to July 5 by the Bench, who gave the government time to respond.

Felling of 50-year-old trees

PILs filed by T Rajnikanth Reddy, a practising advocate, and others against the State Roads and Building and Forest Department for felling 50-year-old trees near Rangareddy Gudem were disposed by the same Bench. The petitioners objected to the removal of trees and the construction of a pipeline without first receiving permission from the proper authorities.

The State’s counsel contended that the government had entered into an agreement with the contractors and that approval had been granted. The number of saplings planted was in line with the number of trees cut, according to the counsel. While dismissing the PILs, the Bench instructed the Forest Department to file a status report to the High Court’s Registrar.
