AMU to Move SC in Case of Removal of BJP Flag From MLA’s Car on Campus

The Aligarh Muslim University (AMU) has chosen to register a petition in the Supreme Court after the Allahabad High Court dismissed the petition of its 12-member proctorial group for quashing of criminal proceedings against them in the case of preventing BJP MLA Dalveer Singh’s vehicle from entering the premises of the campus with a party flag on it and allegedly abusing its driver.

AMU representative Shafey Kidwai stated: “As per the university’s rule, no vehicle bearing flags of political parties is allowed inside the campus. The proctorial staff were only doing their duty when they stopped the said vehicle.”

The 12-part proctorial group had before moved the HC challenging criminal procedures pending against them in the court of the chief judicial magistrate in Aligarh.

However, in the previous, the HC dismissed the petition registered by Professor Brij Bhushan Singh and 11 different members, on grounds that the presence of the accused at the spot for the incident isn’t disputed.

Accordingly, whether they abused the ‘victim’ or can only be resolved by the trial court going through the proof set before it, the court noticed.

The petitioners’ counsel referred to specific circulars of the university prohibiting the utilization of flagged vehicles of any political party on the university grounds.

The state government counsel contended that the offence was ‘serious’ and could have wider ramifications on law and order.

It might be recalled that the incident occurred last year on October 22, when Guddu, the driver of the BJP MLA Dalveer Singh from Barauli constituency of Aligarh, went to get Singh’s grandson, Vijay, from the varsity, however, was allegedly halted by the AMU proctorial group at the main gate.

As per the FIR, the staff members took him out of the vehicle and forced him to remove the party’s flag from the vehicle before permitting it to enter the campus. The complainant additionally stated that when he opposed their move, the proctorial group members allegedly abused him, saying that “BJP members are not allowed on the campus grounds.”

The FIR of this occurrence was filed under segments 342 (wrongful confinement) and 504 (intentional insult with intent to provoke breach of the peace) of IPC on the basis of a complaint registered by the MLA’s driver Guddu at the Civil Lines police department on the same day.
