Delhi SC Criticises Government Over Delays In Appointing High Court Judges; Number Drops to 29 Within A Week

The Supreme Court on Monday had criticized the central government in appointing high court judges for a long gap period. This comes even after the recommendations were cleared by the collegium.

SC Calls Out Central Government Of “Recalcitrant Attitude”

As per the latest reports, a bench comprising of Justices Sanjay Kishan Kaul and Hrishikesh Roy said that they are facing problems with the government’s “recalcitrant attitude” in appointing High Court judges for longer gap years.

The Supreme Court on Monday criticized the government’s “recalcitrant attitude” in not appointing high court judges for years together, even when the recommendations have been cleared by the collegium.

This comes after the bench noted that within a week’s time, the Delhi High Court will have less than 50 percent of less judges. The Delhi high court would have only 29 judges when the vacancy is for 60 judges. The bench further said that this comes after two decades ago the bench appointed 32nd judge of the court and the strength was 33 judges.

The bench further said that the recommendations made by the Additional Solicitor General takes months and years to reach the collegium. This further takes months and years until the decisions are made for the court. They noted that the judicial institutions are run by the judges. However, it will eventually reach a place where it’d be impossible to have an early hearing even about the important issues.

They added that the real concern is the fact that the high court hasn’t made any actions regarding on this either and all they have to do is issue an order.

Central Government Took Long On Filing Counter Affidavits 

The bench noted that the High court had issued a notice on June 4 and called upon counter affidavits from the Central government. However, the government took four weeks to file them and a special leave petition was filed on July 17, 2021.

However, the bench dismissed the special leave petitions and pointed out that the government does not file the counter affidavits while it files the special leave petitions before the court.
