Gurugram Imposes Section 144 On Fireworks Ban

In the latest update, the Gurugram district administration has imposed a blanket ban on the bursting of fireworks for the festive season of Diwali, Gurpurab, Kartik Purnima, Christmas and New Year’s Eve in the area.

The administration has imposed the ban days before and after Diwali which is on November 4, 2021. The Gurugram District Collector, Yash Gard on Monday issued the under Section 144 of the Criminal Procedure Act (CrPC). These orders have been issued in the compliance with the judgement of the Supreme Court for the safety of the public and to control the level of population. Following this, the duty of the SHO has also been defined within the concerned area.

The order said that the concerned station will be in charge of ensuring that the people are complying with the orders and if violated, it would be considered contempt of court and the actions will be taking accordingly. The orders will be coming into immediate effect.

This comes after earlier today, Supreme Court cancelled the ban by the Calcutta High Court regarding complete ban on firecrackers. The vacation bench consisting of Justices AM Khanwilka and Ajay Rastogi said that the green firecrackers that are made using relatively less-polluting material can be used during the festive season, the supreme court said.

They said that a complete ban on firecrackers should not be done. And the ideal way is to strengthen the mechanism to stop the misuse.

The bench asked the West Bengal government to explore the possibility of ensuring that banned firecrackers are not imported in the state and are stopped at the entry points itself. The bench heard the pleas of the manufacturers against the order released by Calcutta High court that banned the use, sale and purchase of all kinds of fire cracks amidst the festive season.
