JNU Scholar Sharjeel Imam arrested: SC to Hear Plea

JNU Ph.D. scholar Sharjeel Imam was arrested by the Special Cell of Delhi police in connection with the February Delhi riots. The charges booked on him are of Unlawful Activities (Prevention) Act (UAPA).

On the production warrant, He was brought back to Delhi from Assam on Sunday.

The Delhi police were booked to carry him to the national capital yet only in front of his takeoff for Delhi, Imam tested positive for COVID-19 on July 21.

Imam is criticized for a case identified with supposed fiery speeches during the protests against CAA and NRC and as of now was lodged in Guwahati jail for a case that is registered by the Assam police related to UAPA.

Delhi Police on July 25 had documented a charge sheet against Imam regarding a case identified with his fiery speeches during the protests against the Citizenship Amendment Act (CAA). The 600-page charge sheet was documented, under segment IPC and Section 13 of Unlawful Activities (Prevention) Act, 1967, 124A (Sedition), 153(A) (Promoting animosity), 153 (Assertion biased to public coordination) (advancing ill will, Hatred between various networks, 505 (spreading gossipy titbits), in Delhi’s Patiala House court.

The Supreme Court on Wednesday dismissed the court by two weeks on the request of JNU student Sharjeel Imam who has booked for clubbing of numerous FIRs leveling rebellious charges against him for purportedly delivering fiery speeches.

A bench of Justices Ashok Bhushan, R.S Reddy, and M.R Shah said it will hear the case after two weeks as the counsel showing up for Imam looked for time to record some extra documents for the case.

The top court had said it can’t pass any between time orders without seeing the replies of all the five states where FIRs were held up against Imam, on June 19.

The governments of Uttar Pradesh and Delhi have filed their counter-affidavits on Imam’s plea but no response has been filed by Arunachal Pradesh, Assam, and Manipur. This was informed earlier to the Apex court and had given another chance to the Delhi government to file its reply in the case.

Imam also has sought transfer of all criminal cases against him to the nation’s capital and investigation by a single agency, in his appeal.

Sharjeel Imam’s lawyer said that “Further developments have happened. We have to inspect court files but due to closure of courts we have not been able to see that.” The charge sheets have been filed in matters that are connected to the case, later on, he also mentioned that “We need to inspect court files but courts are not allowing us to do so due to the lockdown.”

The hearing of Sharjeel Imam’s case has been postponed for two weeks by the Supreme Court of India.
