Live-In Relationships To Be Seen As Personal Autonomy And Not From Social Morality; Allahabad High Court

As per the reports, the Allahabad High Court has stated that live-in relationships have become a part of life. And this needs to be seen from the lenses of personal autonomy instead of notions of social morality.

A division bench comprising of Justice Pritinker Diwaker and Justice Ashutosh Srivastava said that the lIve in relationship has been approved by the supreme court. And should be viewed as a “personal autonomy” out of right to life and personal liberty as guaranteed under Article 21 of the Constitution instead of “notions of social morality”.

Two interfaith couples had filed separate petitions alleging that the families of the girls were interfering in their day-to-day life. One petition was filed by Shaira Khatun and her partner. Both are majors and have been in a live-in relationship from the past two years. The other petition was filed by Zeenat Parveen and her partner from Meerut. They both are also majors.

Both couples filed petitions after the police refused to help them.

Disposing off the petitions, the court underscored that the right to life enshrined under Article 21 of the Constitution is to be protected at all costs. They further held that the police is obligated to protect the same as well. The bench said that when the petitioners who approached the police with complaints of threat to life and liberty. The police shall perform their duties.

This comes after the Delhi High Court called on the Uttar Pradesh police for harassing an adult couple. The Delhi High court slammed the UP police for arresting two men for allegedly kidnapping. The case is being connected to when a woman eloped with a man from Delhi. The court held that such “illegal action” will not be tolerated in Delhi.

During the hearing, the court said the couple got married on their own will on July 1, 2021. The womans’ parents are against the marriage and have repeatedly threatened them.
