SC Warns UP Government Over Holding Kanwar Yatra; ““This or else we pass an order”

Amidst the fears of the third wave of the Covid 19 in India, the Supreme Court has asked the Uttar Pradesh government to reconsider the decision to allow Kanwar Yatra.

UP Government Wants Kanwar Yatra To Be “Symbolic”

As per the latest reports, a bench comprising of Justices R.F Nariman and B.R Gavai said that the authorities should reconsider holding Kanwar Yatra with 100 percent physical capacity.

The bench said that they are prima facie of the fact that this matter concerns every citizen and all the other sentiments including religion sentiments that are equivalent to the right to life of the citizens. However, given the Covid 19 pandemic and the fear of a third wave in India, the authority should reconsider holding the Kanwar Yatra. Supreme Court bench told Senior Advocate C.S. Vaidyanathan, who was representing the UP government.

Justice Nariman said that the “State of UP cannot go ahead with it. 100 percent”. Following this, Vaidhyanathan said that they have submitted an affidavit from the UP government and they want it to be a symbolic yatra.

Supreme Court Threatens To Issue Order If UP Government Doesn’t Reconsider 

Talking about the Kanwar Yatra, Vaidhayanathan said that the State Disaster Management Authority had already deliberated upon the issue. He said that for “compelling religious” reasons, anyone who wants to undertake the Yatra would have to seek confirmation, have a negative RT-PCR and also be fully vaccinated.

Following this, Justice Nariman said that they will give them (UP government) would one more opportunity to reconsider the decision to hold the Kanwar Yatra.

“This or else we pass an order,” said Justice Nariman.
He added that they are all Indians, and this suo moto has been taken up as the Article 21 that applies to everyone. And if the government doesn’t reconsider the decision, they will deliver the order.
