Telangana HC directs Sharmila not to proceed with her padayatra till further orders

Justice B Vijaysen Reddy of the Telangana High Court on Tuesday directed YS Sharmila not to proceed with her padayatra and public meeting in Mahabubabad until further orders of the High Court.

Sharmila was directed by the judge to file an affidavit undertaking she would not make derogatory remarks or give provocative speeches. Sharmila filed the case challenging the rejection of permission for the padayatra and public meeting within the limits of Mahabubabad Police Station, Mahabubabad District as being illegal. The Government Pleader for Home informed the court that Sharmila was not following court orders. He said she was making derogatory and vulgar remarks during her public meetings.

While watching a clipping of the meeting, the judge wondered how the petitioner could make such comments. Sharmila’s Counsel responded that she was responding to derogatory remarks made about her in the same way. The judge asked would the petitioner accept such comments against her by male politicians. The judge warned the petitioner against violation of the court orders. Directing the petitioner to file an affidavit the judge adjourned the case to March 3.

The Telangana High Court declined to hear an interim petition by the Telangana government seeking suspension of the single judge’s order to transfer the investigation into the MLAs poaching case to the Central Bureau of Investigation (CBI).

The state government had requested a stay on December 26, 2022 order for three weeks facilitating it to move the Supreme Court.

Chief Justice Ujjal Bhuyan made it clear that because the matter was heard and decided by the division bench, it cannot be heard again by the court and that the order can only be challenged in the Supreme Court.
