Telangana HC extends stay on notices issued to BL Santhosh till Dec 30

On Thursday, the Telangana High Court extended the earlier-ordered stay on the notices issued to senior BJP leader BL Santhosh until December 30.

Santosh is the chief of Bharat Dharma Jana Sena Tushar Vellapally and Kerala-based doctor Jaggu Swamy, booked in the Poachgate case under Section 41-A (Notice of Appearance Before Police Officer) of the CrPC.

The counsel representing BJP urged the court to extend the stay and reminded Justice K Surender that the earlier stay he imposed would expire on Thursday.

It can be recalled that the ACB court previously refused to take on record a memo filed by the special investigation team, which named Santhosh, Tushar, and Jaggu Swamy as accused in the case.

The state was aggrieved by this order of the ACB court since it called into question the very foundation of the Poachgate case by raising concerns about the agency’s competence.

“We did not ask the ACB court to adjudicate our memo. It was a mere intimation about adding the names of the three new accused,” advocate general BS Prasad said while arguing last week.

After briefing the judge on the entire matter, he stated that because the order on the ACB court’s decision will have an impact on the current case, he adjourned the case.

It is worth recalling that the Special Investigation Team (SIT) named the senior BJP leader BL Santhosh and three others as accused in the case of an alleged conspiracy to poach four TRS MLAs.

Based on their findings, the SIT filed a memo in a special Anti-Corruption Bureau (ACB) court here, adding the names of Santhosh, Jaggu Swami and Tushar Vellapally, along with B Srinivas, as accused persons in the case.

Three people — Ramachandra Bharati alias Satish Sharma, Nanda Kumar, and Simhayaji Swamy — were already named as accused in the case after a complaint was filed against them on October 26 by TRS MLA Pilot Rohith Reddy, one of four legislators.
