Plea Challenges Rakesh Asthana’s Appointment as Delhi Police Commissioner; SC Responds

The Supreme Court recently received a petition challenging the appointment of Rakesh Asthana as the Delhi Police Commissioner.

Supreme Court Bench Responds “We Will See”

The plea was moved by Advocate ML Sharma. The plea stated that Asthana’s appointment as the Delhi police commissioner came a day before his superannuation on July 31. This would further increase his tenure for one year.

The bench comprising Chief Justice N.V Ramana and Justice Surya Kant heard the petition. Justice Ramana said, “”Let us see if it is numbered. Let the petition be numbered first. We will see”.

In the appeal, Sharma guaranteed Asthana’s arrangement didn’t follow the top court judgment followed through on July 3, 2018. “Every one of the States will send their recommendations fully expecting the opening to the Union Public Service Commission, well on schedule somewhere around 90 days before the date of retirement of the officeholder on the post of Director General of Police,” the supplication refered to a selection from the judgment.

The request contended that Amit Shah and Prime Minister Narendra Modi headed the Appointments Committee of the Cabinet (ACC) purposely and intentionally acted against the Supreme Court judgment, subsequently a genuine hatred of court is obligated to continue against the two respondents.

Plea Suggests Acts Of Lack Of Confidence To Forestalled

The plea further said that the expectation of the denounced in a disdain case is insignificant. The main thing is the impact or the conceivable impact of his follow up. Any demonstration which causes absence of trust in the organization, or in any case meddles or will in general ruin it, must be forestalled.

The plea added that the Centre already gave additional charge of the Delhi Police Commissioner to Balaji Srivastava after the retirement of SN Shrivastava on June 30. And at that time, it was not reported that the charge was temporary.
