Raja Singh’s wife files petition challenging his detention in HC

In a writ petition filed before the Telangana High Court, T Usha Bai challenged the detention of her husband BJP MLA T Raja Singh by the Hyderabad police under the Preventive Detention (PD) Act.

After making derogatory remarks against Prophet Muhammad in a Youtube video on August 22, the legislator was arrested on August 26.

In accordance with article 226 of the Indian constitution, the petition has been filed. As Usha Bai contended, the Hyderabad police violated the mandatory provisions of the PD Act while invoking it without following the principles and guidelines issued by the Supreme Court and High Court. Currently, Raja Singh is being held in Cherlapally jail.

Raja Singh’s wife said the relevant documents that were used to make the recommendation for detention were not provided in Hindi, the mother tongue of the detainee.

He was not given an opportunity to make a proper and written representation before the advisory committee, according to her. Usha Bai argued in her petition that calling her husband a ‘Goonda’ for the purpose of preventing him from engaging in dangerous activities in the future is “absurd and illegal”.

Moreover, the petitioner informed the court that invoking the PD Act against her husband was done “to satisfy a section of the public”.

Raja Singh had been taken into custody “only to appease them” and not for any other reason, she said.

Moreover, Usha Bai said that it showed the “incompetence” of the state police authorities, which failed to maintain law and order.

On August 23, Raja Singh was arrested and secured bail the same day. In the Old City, mainly Muslim youth protested against him because of the same reason. As a result, the police cracked down on protestors. Following his arrest under the PD Act on August 26, his supporters staged a few protests to demand his release.

In addition to calling the detention illegal, Usha Bai asked the court to quash the PD Act proceedings initiated by the Hyderabad police. Raja Singh has been lodged in the Cherlapally central jail since his arrest, and the jail’s security has been increased.
