Supreme Court Expresses Concern Over Extensive Use of Preventive Detention Act in Telangana

Hyderabad: The Supreme Court of India has expressed grave concern about the widespread application of the Preventive Detention (PD) Act in the state of Telangana. The Supreme Court’s statements emphasize the importance of law enforcement officials protecting citizens’ fundamental rights and freedoms.

During the 75th anniversary of India’s independence, as part of the ‘Azadi Ka Amrit Mahotsav,’ the Supreme Court chastised Telangana police for a “over-enthusiastic” application of the PD Act, which resulted in the detention of numerous young people. The court observed that certain police officers were using the PD Act in ways that violated citizens’ rights and liberties.

These remarks were delivered at a hearing on a plea brought by the wife of Salman, a Hyderabad-based youngster. She went to the Supreme Court after failing to secure remedy at the Telangana High Court.

The bench, which included Justices Surya Kant and Dipankar Datta, harshly criticized the Telangana police’s attitude, reminding them that lawmakers intended the statute to be used in unavoidable situations, not arbitrarily.

While emphasizing the importance of upholding people’ constitutional rights, the Supreme Court referred to Articles 14, 19, and 21, which include the right to free expression. The court emphasized that every citizen is equal in the eyes of the law and has fundamental personal liberties protected by the Indian Constitution.

Furthermore, the Supreme Court emphasized the importance of courts scrutinizing the reasons made by PD Act enforcers, emphasizing that the misuse of such a statute represented a harm to citizens’ liberty.

In essence, the court requested that the distinction between upholding law and order and keeping public order in the state’s policing efforts be reconsidered. This action emphasizes the need of balancing security and individual rights in law enforcement procedures.
