Telangana High Court orders State government to publish all GOs to websites

On Thursday, a two-judge panel of the Telangana High Court, comprised of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili, ordered the State Government to publish all Governmental Orders into the public domain on their respective websites within eight weeks.

The panel was hearing a PIL filed by P Sekhar Rao regarding the lack of public access to Government Orders in the public domain. He further questioned the failure to appoint a nodal officer as required by law for the same purpose.

The panel urged the government to appoint a Nodal Officer in accordance with their own order rather than the Central Government’s guidelines and to ensure strict compliance of the same.

The panel further instructed the state government to post all Governmental Orders into the public domain within 8 weeks starting today.

Relief for Chief Secretary

Justice Ujwal Bhuyan and Justice A Venkateshwar Reddy of the Telangana High Court granted relief to Chief Secretary Somesh Kumar from personal attendance before the Central Administrative Tribunal (CAT) on Friday.

The panel was hearing his petition in response to a contempt petition filed in CAT. Concerning the reallocation of Central Services workers, a contempt lawsuit was filed against the Chief Secretary. The tribunal ordered that Abhishek Mohanty, an IPS officer, be transferred to the Telangana Cadre, which had been pending for the previous seven months.

Somesh Kumar was summoned to appear before the CAT on March 11. In an interim application, the Advocate General sought a stay of the CAT order. He stated that they have requested clarity from the Central Government and are awaiting a response. The panel directed Advocate General BS Prasad to obtain guidance on how to comply with the CAT’s orders.

Disqualification of BJP MLAs

On Thursday, Telangana High Court Justice Shameem Akther reserved orders on a writ contesting the suspension of three Bharatiya Janata Party MLAs — T Raja Singh, Eatala Rajender, and Raghunandan Rao – from the ongoing session of the Telangana Legislative Assembly.

The court had previously ordered notices to be served on the Secretaries of the Assembly and the Secretariat, and the court was informed that the bailiff was not permitted to enter the Assembly premises to serve the notices.

Senior Counsel D Prakash Reddy, who represented the MLAs, maintained that one constitutional body was interfering with the operation of another constitutional body. The three MLAs were suspended on the charge of obstructing Assembly procedures.

The three MLAs moved the court seeking directions to permit them to attend the session till it ended. The judge, noting that the Secretaries of the Assembly were not represented in court, reserved the case for orders.
