Telangana High Court refuses to hear interim petition in MLA poaching case

According to the latest reports, the Telangana High Court on Wednesday declined to hear an interim petition by the Telangana government seeking suspension of the single judge’s order to transfer the investigation into the MLAs poaching case to the Central Bureau of Investigation (CBI).

The state government had requested a stay on December 26, 2022 order for three weeks facilitating it to move the Supreme Court.

Chief Justice Ujjal Bhuyan made it clear that because the matter was heard and decided by the division bench, it cannot be heard again by the court and that the order can only be challenged in the Supreme Court.

Advocate General B. S. Prasad informed the Chief Justice that the CBI is pressuring for the case file. He stated that the CBI requested the case file from the Chief Secretary again on Tuesday.

The Advocate General sought permission from the Chief Justice a day after Justice B. Vijaysen Reddy suggested it when the interim petition was heard before him on Tuesday.

On December 26, Vijaysen Reddy issued his order, handing over the case to the CBI. He had also quashed the Government Order (GO) establishing a Special Investigation Team (SIT) to investigate the alleged attempt to poach four Bharat Rashtra Samithi legislators (BRS).

The single judge ruled on petitions filed by accused priest Ramchandra Bharati, pontiff Simhayaji, and restaurant owner Nandu Kumar that they did not have faith in the SIT investigation.

The judge also stated that the media should not have been allowed access to the investigation materials. He also noted that the state has yet to respond to the question of who provided investigative materials to the Chief Minister.

On February 6, a division bench comprising of Chief Justice Ujjal Bhuyan and Justice N Tukaramji dismissed the state government’s petition challenging the single judge’s order transferring the case to the CBI.

The division bench ruled that the order of the single judge bench could not be faulted or interfered with.

The three accused were apprehended by Cyberabad police from a farmhouse in Moinabad, near Hyderabad, on the night of October 26, 2022, while allegedly attempting to lure four BRS MLAs with huge money.

The raid was carried out by Cyberabad police following a tip from Pilot Rohit Reddy, one of the MLAs. He alleged that the accused offered Rs 100 crore to him and Rs 50 crore each to three others to make them “defect to BJP”.

To investigate the case, the state government formed SIT led by Hyderabad police commissioner C.V Anand.
