Delhi High Court Denies Bail To Shahrukh Pathan For Involvement In Delhi Riots

In a recent development in the Shahrukh Pathan case, the Delhi High Court on Thursday has denied bail. He was seen pointing a gun at the unarmed Delhi Police personnel during the Delhi riots.

Evidence Against Shahrukh Pathan Shakes Court’s Conscience 

As per the latest reports, a single bench of Justice Suresh Kumar said that the videos and pictures played as evidence before the court have shaken their conscience. It shocks them how the petitioner could take the law and order in his hands.

The High court noted that whether or not the petitioner had the intention of killing the complainant or any person present in the public at that moment. He had the pistol in his hands and conducted open air shots. Furthermore, it is hard to believe that Shahrukh Pathan had no idea that his act may harm anyone present in that spot.

Noting the gravity of the crime committed by the petitioner along with the present facts of the case, Justice Suresh Kumar decided to grant bail to Shahrukh. The Delhi Police was presented by Advocates Rajat Nair and Amit Mahajan.

During the hearing, the court also noted that Pathan’s role was not only about the participation in the riots but also heading a large crowd with a pistol in his hand. And shooting the open air shots.

As the court declined to grant him bail, the High Court said, “the petitioner (Pathan) is alleged to have participated in riots and his picture speaks a volume about his involvement.”

Shahrukh Pathan’s Video Went Viral Over Social Media 

In February 2020, during the Delhi Riots, Shahrukh Pathan’s video of pointing a pistol at the unarmed Delhi Police personnel went viral over the social media. He is a resident of north-east Delhi and was seen pointing the pistol at the Jaffrabad-Maujpur road. The police later arrested him on March 3, 2020.

The police has submitted the charge sheet in the case to the court and the trial is in progress. The police has urged the court to show no leniency towards the petitioner. Pathan moved towards the High Court after the Trial Court denied to grant him bail.
